Mr.Mehmood Anwer Hussain Balouch, Advocate has filed Vakalatnama for respondent No.2 along with counter affidavit. Respondent No.3 has also filed comments, which are taken on record. Learned counsel for the petitioner submits that he will be satisfied if the petitioner’s alternate prayer is allowed in which he prayed that proceedings arising from FIR Nos.1154/10 and 652/2006 be transferred to the court of one Judicial Magistrate, who will decide both the proceedings expeditiously. Learned counsel for respondent No.2 submits that without prejudice to the defence taken in the counter affidavit and without accepting allegations leveled against respondent No.2 by the petitioner, he has no objection to the grant of alternate prayer as the respondent No.2 himself very much keen that the cases be transferred and dispose of expeditiously. Learned AAG has also no objection. This petition is disposed of with the direction to the learned District Judge, South Karachi to transfer the proceedings emanating from FIR Nos.1154/10 and 652/2006 to the court of any Judicial Magistrate other than IIIrd and VIth Judicial Magistrate. The learned Judicial Magistrate, who will be assigned the case will dispose of the matter within a period of three months with compliance report to this court. The petition is disposed of.
