Petitioner has challenged demand notice dated 27.03.2008
in which Cantonment Executive Officer, Malir
Cantonment communicated to petitioner that as per policy framed by the Board
vide CBR No.3 dated 27.09.2005 regarding extension in validity of layout plan
till September, 2008, petitioner is liable to pay Rs.50,00,000/-
at the rate of Rs.2,00,000/- per defaulting year as Compensation Fee as on
12.+04.2008 for non-completing all required internal/external development in
time. Learned counsel for petitioner submits that in terms of impugned demand
notice, petitioner agrees to pay the amount provided that the required
extension is granted. Learned counsel for respondents submits that calculation
was made upto 12.04.2008 at the rate of Rs.2,00,000/-
per defaulting year as Compensation Fee and if petitioner agrees to pay
Rs.2,00,000/- for each defaulting period after 2008, the extension will be
accorded.
By consent, this petition is disposed of with the
directions to petitioner to pay required amount including Rs.2,00,000/- per defaulting year after 2008 as per impugned
demand notice and thereafter required extension for completion of project will
be accorded by respondents. Petition is disposed of in the above terms.
