This is a suit for recovery of damages on account of illegal dismissal from service. Only on one date the counsel for the plaintiff appeared in this case in the month of September, 2010, thereafter, on 8.5.2012 and urgent application was moved, but nobody appeared for the plaintiff so the urgent application was dismissed with cost of Rs.1,000/-. On 11.11.2013 again counsel for the plaintiff was called absent when the injunction application was fixed for hearing and the matter was also fixed for settlement of issues. Since nobody was present, I dismissed the injunction application but the office has again fixed the same application for hearing, which was dismissed earlier. Today, the matter is fixed for settlement of issues, neither the plaintiff is present nor his counsel. The date of settlement of issues is date of hearing and in case of default the suit can be dismissed for non-prosecution. The conduct of the plaintiff shows that he has lost interest in this case. Consequently, the suit is dismissed for non-prosecution.
