                        The comments have been filed by the Senior Superintendent of Police, Jacobabad. He stated that the alleged detenues  shown in para No.2 of the petition are in fact detenues of C.P.No.D-580/2012 which detenues have been recovered from the custody of the official respondents of the said petition and the action was ordered to be taken against them which include departmental action. Learned counsel for petitioner submits that in addition to the departmental action penal action is also required to be taken against them who have detained the detenues illegally and unlawfully.

                        Be that as it may, since that petition is not before me,  no penal action is to be passed. In the light of the comments, the instant petition has become infructuous, if at all learned counsel is aggrieved that penal action is to be taken against the official respondents of C.P.No.D-580/2012, they may move appropriate application if so advised. It is agreed that the petitioner may record their statement before the concerned officer and they may act strictly in accordance with the law after recording of the statement. Petition stand disposed of.
