            The learned counsel for the respondents concedes that the petitioner was appointed as Junior Clerk on daily wages in the year 2004, and working against permanent post. However, subsequently the Finance Department has reduced number of seats from 39 to 20, and as such at the moment there is no seat lying vacant. It is agreed that, if     at-all, any post is lying vacant or in near future any post get vacant the petitioner would be automatically eligible and entitled to be regularized against that post.

            The petition sands disposed of.
