                   It is reported that the appellant/accused, namely, Muhammad Rafique son of Ghulam Sarwar expired on 28.2.2010.  The accused was convicted vide judgment dated 29.4.2006, against which he preferred this appeal under Section 48 of the Control of Narcotic Substances Act, 1997.  In view of this statement and Death Registration Certificate, which is placed on record, this appeal cannot proceed and accordingly the proceedings of this appeal are abated in terms of Section 431, Cr.P.C. 

                   Appeal is disposed of in the above terms.
