Ahmed Ali M.Shaikh, J. Petitioner seeks employment in Revenue Department in terms of Rule 11-A of Sindh Civil Servants (Appointment, Promotion and Transfer) Rules,1974 on the ground that his father was serving as Naib Qasid in the department and lost his breath while being in service.

2. Comments have been furnished by respondent/Deputy Commissioner, Larkana whereby he did not dispute the claim of petitioner and has categorically stated in para No.4 of the petition that petitioner’s application was forwarded from the office of defunct District Coordination Officer, Larkana with annexed documents to the Secretary Revenue, Board of Revenue, Sindh Hyderabad vide DCO Larkana’s office letter dated 27.01.2009 however, the Assistant Secretary, Board of Revenue vide his letter dated 15.12.2009 had informed the DCO that request of the applicant/petitioner was turn down on the ground that his father expired on 30.4.2006 whereas the policy was effective from 17.7.2007. Since the respondents have not denied claim of the petitioner but his request was turn down on the ground that since his father expired in 2006, therefore, he is not entitled for the relief as prayed in this petition.

3. Be that as it may, since the petitioner’s father was low paid employee and was said to be lone bread winner of his family, therefore, we allow this petition on humanitarian grounds and direct the respondents to accommodate the petitioner against the post of Naib Qasid/Peon/Chowkidar.

4. For the foregoing reasons, the instant petition was allowed by short order announced today in open court.
