                   Learned counsel for the applicant submits that this transfer application has been moved on the ground that the learned Presiding Officer i.e. District & Sessions Judge/Special Judge (Narcotics) Shikarpur, who has been recently posted is caste fellow of the applicant and has remained with him since childhood, as such in the interest of justice, he has moved this transfer application.

                   The comments were called from the District & Sessions Judge/Special Judge (Narcotics) Shikarpur, wherein he has stated that he has already given his no objection in terms of his report dated 12.10.2012. The report dated 27.11.2012 is also on record, where such observation were made. Learned State Counsel today appearing submits that in view of no objection given by the learned Presiding Officer, he has also no objection if the case is transferred to the nearest Court of District & Sessions Judge, Shikarpur. It is furthte3r brought on notice that the complainant in the case has also expired and evidence of number of the witnesses have been recorded, therefore, in view of such facts and circumstances, let the case be transferred and tried by District & Sessions Judge, Jacobabad which is the nearest place of District Shikarpur so as to minimize the traveling botheration. Crl. Misc. Application stands disposed of.
