Through this Constitutional Petition, the petitioner Muhammad Alam has prayed for the following relief(s):
a) That, this Honourable Court may be pleased to declare that action of respondents for not providing ‘Wattan Cards’, seed, fertilizer and other aid to the petitioner and his other family members are illegal malafide and is in violation of fundamental rights of the petitioner and his other family members, particularly “Right to live” guaranteed under Article ‘9’ of the Constitution.
b) To direct respondents to execute the notification dated 14.9.2010 and provide ‘Watan Cards’, seed, fertilizer and other aid to the petitioner and his other family members who belong to calamity effected areas in District Kamber-Shahdadkot without any discrimination.
c) To issue directions to respondent No.10 to restore the Canals and water of Deh Siyal village Arif Brohi Taluka Shahdadkot and to display time frame for the restoration of the same.
d) Award costs of the petition to the petitioner.
Comments are filed by respondents No.3 & 4. Learned advocate for the petitioner submits that he would be satisfied if directions are issued to the respondents to provide him due relief as notified by Government to the flood affectees. Learned Addl. A. G states that case of the petitioner shall be dealt with in accordance with the law and if he qualified for the said relief, same will be granted to him. Learned D.A.G submits that they will follow the recommendations made by provincial Government in this regard for issuance of ‘Watan Cards’ as per law.
In these circumstances, the petition stands disposed of accordingly. This exercise shall be completed within two months from today.
