Respondents No.2, 3, 6 and 7 are present in person.

                   Through this Constitutional Petition, petitioner Seengar Hussain Balro has prayed for the following reliefs :-

a)                 That this Honourable Court may kindly be pleased to call and direct the respondent No.1, not to violate fundamental rights and legal privileges of petitioner and to avoid from arresting, harassing, pressurizing or confining him except due course of law at the behest of private respondents and act in accordance with law;

 

b)                 That this Honourable Court may also kindly be pleased to direct the S.S.P., Larkana (respondent No.9) to ensure legal protection to petitioner, against apprehended life and property loss at the hands of respondents, in accordance with law.

 

c)                  To pass any other order as deemed fit and proper to secure legal privileges of petitioner and their families under the prevailing circumstance according to law.

 

 

                   Notices were issued to the respondents as well as A.A.G.  Comments have been filed by respondents No.1 and 9.

                   Mr. Saleemullah Abbasi, advocate, files Vakalatnama on behalf of respondents No.2 and 3. 

                   Respondents No.1 and 9 in the comments have stated that there is dispute between the petitioner and private respondents over the property and petitioner shall be provided protection if he need so and approached to the concerned police.  Private respondents, namely, Muhammad Yasin, Ghulam Rasool, Anwar Ali and Abdul Manan present in the Court state that they have never issued threats to the petitioner but there is dispute over the land between the parties. 

                   Learned State Counsel states that every protection shall be provided to the petitioner in accordance with law.  In these circumstances, learned advocate for the petitioner does not press this petition more and it is disposed of accordingly, without prejudice  to the rights of the parties as regards to the dispute over the land is concerned.
