                   Through this Constitutional Petition, petitioner Niaz Hussain Mugheri has prayed for the following reliefs :-

a)                 That this Hon’ble Court may be pleased to direct respondents No.1 to 3 to arrest remaining accused of crime No.252/2012 of PS Kamber and further to direct respondent No.1 to conduct honest fair, impartial investigation and direct respondent NO.3 to supervise the investigation;

 

b)                 To direct respondent No.1 to 3 to provide legal protection to the petitioner and his family members as the accused persons are continuously issuing threats of dire consequences and of murder;

 

c)                  To award costs of this petition;

 

d)                 Any other relief available under the circumstances may also be granted to the petitioner.

 

 

                   Notices were issued to the respondents as well as A.A.G.  Comments/statements have been filed by S.H.O. PS Kamber and S.D.P.O., Kamber, which are taken on the record, in which it is stated that during the course of the investigation nominated accused Haji Muhammad Uris, Muhammad Ramzan and Abdul Hameed were arrested and challan has been submitted in this case on 13.9.2012 before the competent Court of law. 

                   Mr. Rafique Ahmed Abro, learned advocate for petitioner, states that he would be satisfied if directions are issued for the arrest of absconding accused in this case.  Request is reasonable.  After hearing learned State Counsel, learned trial Court is directed to make the efforts for arrest of the absconding accused, if any, in the case.  In the circumstances, learned advocate for the petitioner does not press this petition more and it is disposed of accordingly.
