                        Mr. Liaquat Ali Baloch, advocate for the applicant/complainant  submitted that summary order dated 21.03.2011 in Crime No.64/2010 registered at P.S Kashmore U/S 435, 436 PPC have been  passed by learned 1^st Civil Judge and Judicial Magistrate, Kashmore without hearing  both the parties.  He submitted that provisions of the natural justice have been violated.

                        Mr. Naimatullah Bhurgri, State Counsel and Mr.Faiz Mohammad Larik, learned counsel for the accused  admit  that  before passing  impugned order parties were  not heard. 

                         Therefore, by consent order dated 21.03.2011 is set aside.   Matter is  remanded  to learned 1^st Civil Judge and Judicial Magistrate, Kashmore for re-hearing of both the parties and to pass detailed order by assigning  the sound reasons  in accordance with the settled principles of law. 

                                   Criminal Miscellaneous Application is disposed of accordingly.
