            Through this constitution petition, petitioner Mst. Fahmeeda has prayed for the following reliefs:-

(a) That, this Honourable court may be pleased to direct the respondents No.1 to 3 to arrest nominated accused of crime No.78/2012 of PS Thul and submit the remand before competent court of law.

(b) That, this honourable court may be pleased to call upon respondent No.4 and direct him for taking legal action against respondents No.1 to 3 for their illegal acts and further may be directed him to appoint any honest/independent officer into the matter for arresting the nominating accused.

(c) That, award costs.

(d) That, grant any other equitable relief.” 

            Notices were issued to the respondents as well as Additional A.A.G. Comments have been filed by respondents.

 Learned counsel for the petitioner pointed out that case bearing crime No.78/2012 under section 302, 337-H(2), 34, PPC registered at Police Station Thul has been challaned. Presently, it is pending in the Court of learned Sessions Judge, Jacobabad.

Learned trial Court is directed to issue non bailable warrants against the absconding accused. SSP Jacobabad shall ensure the execution of non bailable warrants against the absconding accused in accordance with law.

In the light of above observation, learned counsel for the petitioner does not press this petition more and it is disposed of accordingly.
