            Through this criminal transfer application applicant/accused seeks transfer of sessions case No.436/2011 re. Irfan and Ayaz Hussain Chandio and others under sections 302, 324, 148, 149, PPC pending in the Court of Learned 7^th Additional Sessions Judge, Larkana. Notice of this application was issued to the respondents and comments were ordered from the trial Court.

            Mr. Habibullah G. Ghouri, learned counsel for the applicant submits that court of 7^th Additional Sessions Judge, Larkana is lying vacant since long. There is no progress in the case. Speedy trial is right of the accused. Case may be transferred to some other court.

            Mr. Naimatullah Bhurgri, appeared on behalf of the State and admitted that court of 7^th Additional Sessions Judge, Larkana is lying vacant and recorded no objection in case transfer application is allowed.

            Speedy trial is the right of every accused. Court of 7^th Additional Sessions Judge, Larkana is lying vacant. Keeping in view the National Judicial Policy, 2009 and the circumstances of the case, transfer application is allowed. Case is transferred from the Court of 7^th Additional Sessions Judge, Larkana to the Court of learned Sessions Judge, Larkana for disposal according to law.
