                        Through this Constitutional Petition, the petitioner Nasrullah has prayed for the following relief(s):

ix)     Direct the respondent No.1 to 4 to issue appointment letter to the petitioner without any further delay.

ii) Direct the respondents No.2 to 4 to cancel the appointment of respondent No.5 if issued and he has neither joined not performing his duty as his appointment is contrary to the Government Policy.

iii) Award the costs of the petition to the petitioner.

iv) Any other adequate, efficacious remedy which this Honourable Court deems fit and Proper in the circumstances of the case.

                        Learned advocate for the petitioner does not press this petition for respondent No.5. Therefore, by this order rights of respondent No.5 shall stand protected.

            Learned Addl. Advocate General at the very outset stated that a person who has donated plot for school is entitled to nominate one person for employment as per government policy. He further states that concerned nominee or donor of the plot shall be appointed within two months after fulfilling requisite formalities. The learned advocate for the petitioner is satisfied with this proposition.

            In such circumstances, the petitioner  is directed to submit application to the concerned respondent, enclosing therewith following documents:

(i) Copy of Agreement Bond signed by the applicant/plot donor and EDO (E)  regarding construction of School building.

(ii) Copy of Form VII-A/ VII-B duly signed by Mukhtiarkar (Land Revenue) concerned showing the ownership of plot/land of the applicant.

(iii) N.O.C of other shareholders of land/plot and other heirs of property.

(iv) Qualification certificates, CNIC, Domicile and PRC of the applicant, Certificate from relevant officer that land donated for construction of school building stand transferred in the name of Education & Literacy Department, Government of Sindh.

By consent petition is disposed of in the above terms.
