            Though this constitution petition, petitioner Imdad Hussain has prayed for the following relief (s) :-

(a)               That this Honourable Court may be pleased to direct the respondents No.1 to 3 to arrest the accused nominated in the FIR bearing crime No.88/2011 of P.S Taluka, without any further delay.

(b)               To direct respondent No.1 to 3 to provide protection to the lives of petitioner, his witnesses and family members as per law.

(c)                To award costs of this petition to the petitioner.

(d)              Any other relief available under the circumstances may also be granted to the petitioner.

 

 

            Mr. Rafique Ahmed K. Abro, learned  counsel for the petitioner submits that petitioner Imdad Hussain had lodged FIR at Police Station, Taluka, Larkana. It was recorded vide crime No. 88/2011 on 01.11.2011 under section 302, 148, 149, 337-H(2), PPC. Accused were nominated in FIR but police made no efforts for arrest of the accused and submitted challan under section 512, Cr.P.C. Presently, case is pending in the court of learned Sessions Judge, Larkana. Grievance of the petitioner is that police made no sincere efforts for arrest of the accused wanted in the above mentioned crime. It is also pointed out that non bailable warrants have also been issued by the trial Court but local police has returned the non bailable warrants unexecuted.

 Trial court is directed to issue non bailable warrants, the same shall be sent to SSP Larkana who will depute the responsible police officer not below the rank of DSP for execution of non bailable warrants. The same shall be executed in accordance with law. Thereafter case shall be proceeded by the trial Court in accordance with law. In these circumstances, learned counsel for the petitioner stands satisfied. The petition is disposed of accordingly.
