At the very outset Mr.Mohammad Bachal Tunio, learned A.A.G agrees to the disposal of the present petition in terms of the orders passed by this Court in Constt: Pett: No.D-2520/2010 dated 15.09.2011 decided at the Principal Seat in the following terms:

i. The Chief Engineer Respondent No.3 Guddu Barrage Sukkur may carry out the inspection of the subject contracted work and evaluate the work as has been carried out by the petitioner and sanction such amount as may be commensurate to the work done. Any deficiency and or defect in the contracted work as may be noted by Executive Engineer, he will be at liberty to take such action as may be within the contemplation of the contract.

ii. In case Chief Engineer comes to a conclusion that the measurement carried out by the Executive Engineer and or Assistant Engineer Annexure”C” page 45 to 77 are managed or incorrect for any reason he may initiate such proceedings or action departmentally against such persons as may be permissible under the law.

iii. The entire exercise to be completed preferably within a period of 30 days from the receipt of this order.

As regards the condition (ii) is concerned, the same shall be considered by the Chief Engineer Guddu Barrage keeping in view of the subject matter of this petition individually. Petition stands disposed of. Copy of this order be sent to the Chairman Federal Flood Commission, Islamabad for information and compliance.
