Through this Constitutional Petition, petitioner Zohaib Ali has prayed for the following relief(s):

a) That this Hon’ble Court may be pleased to direct duty officer/respondent No.1 to record statement of the petitioner and incorporate it in 154, Cr.P.C book verbatim to the petitioner and thereafter proceed further in accordance with law.

b) This Hon’ble Court further be pleased to quash the FIR No.46/2012 of PS Airport, Jacobabad in the light of the facts and grounds mentioned above.

c) To direct the respondent No.1/SHO to record statement of petitioner/abductee and thereafter produce him before the concerned Magistrate for recording 164, Cr.P.C statement with further directions to the respondent No.1 to proceed further in accordance with law.

d) To direct the respondent No.3 (SSP Jacobabad) to provide legal protection to the petitioner and his family members and ensure that no further false and fabricated case is registered against petitioner and his family members without prior permission of this Honourable Court.

e) To direct respondent No.3 (SSP Jacobabad) to appoint some honest and well reputed police officer not below the rank of DSP to conduct fair and impartial enquiry regarding FIR No.121/2012 of PS Saddar, Jacobabad and FIR No.76/2012 of PS Civil Line, Jacobabad and submit report before this Honourable Court for further necessary action.

f) Award costs.

Notices were issued to the respondents as well as Addl. A. G. Mr. Ameer Ahmed Narejo, learned State Counsel states that official respondents shall provide every protection to the petitioner as provided in law. As regard to the high handedness of the police officials, SSP Jacobabad shall hold enquiry and to fix the responsibility and dispose it of at his level according to law and submit such report before Additional Registrar of this Court within thirty days. In these circumstances, learned advocate for the petitioner does not press this petition more and it is accordingly disposed of.
