            Learned counsel for the applicant submits that learned Civil Judge and Judicial Magistrate, Thull, has deeply considered each and every aspect of the case by his order dated 06.12.2011. He further submits that it appears that learned Civil Judge and Judicial Magistrate has exercised powers of Court of Sessions by appreciating the evidence. Mr. Naimatullah Bhurgri, State Counsel, assisted by Mr. Sardar Khan Lashari, Advocate for complainant supported impugned order. 

            Apparently, learned Civil Judge and Judicial Magistrate, Thull, was not supposed to go into the merits of case so deeply.  However, learned Sessions Judge, Jacobabad, is directed to apply his mind to the facts and circumstances of the case, and proceed with the matter strictly in accordance with law. In view of above,            Mr. Asif Ali Abdul Razzak Soomro, Advocate for applicant does not press this application more, the same stands disposed of in the above terms terms.
