                        Learned advocate for applicant has impugned order dated.27.6.2011, passed by learned Additional Sessions Judge, Mehar in Sessions Case No.45/2008 State v. Tooh Khoso and others under section 324, 353, PPC, 17(3), Offences Against Property (Enforcement of Hudood) Ordinance, 1979, whereby fine of Rs.50,000/- was imposed upon Muhammad Hayat, who had stood surety for accused Tooh.

                        Notice was issued to learned Addl. A. G. for State. Learned advocate for the applicant states that accused Tooh could not appear in the Court because of the recent rains in district Dadu, he is flood effectee and a poor person. He further submitted that he does not press this revision on merits and prayed that lenient view may be taken. Learned State Counsel submitted that he has no objection if lenient view is taken in the matter. Therefore, keeping in view submissions made by learned advocate for applicant fine of Rs.50,000/- is reduced to Rs.30,000/-. With this modification, this revision is disposed of in above terms.
