Mr. Ghulam Rasool Narejo, advocate for respondents No.2 to 4, who are also in attendance.

                   This Constitutional Petition has been filed by petitioner Naseer Muhammad Bhutto for following reliefs :-

 

a)                 That, this Hon’ble Court may be pleased to call upon respondents No.2 to 4, restraining them from causing harassment to the petitioner in any manner, with further direction to them not to take the law into their hands.

 

b)                 That, this Hon’ble Court may further be pleased to direct respondents No.1 and 5 to provide adequate protection to petitioner and his property.

 

c)                  That, this Hon’ble Court may further be pleased to direct the respondent No.1, to take action under chapter proceedings against the respondents No.2 to 4, and report the matter to concerned Magistrates having jurisdiction for executing bonds with or without sureties for the purpose of keeping peace and good behaviour.

 

d)                 To award costs.

 

e)                 Grant any other equitable relief.”

 

 

                   Notices were issued to the respondents as well as A.A.G.  Comments have been filed by the respondents No.2, 3 and 4.  Learned A.A.G., is appearing on behalf of the official respondents.  In the comments filed by respondents No.2, 3 and 4, it is stated that no harassment whatsoever has been caused to the petitioner, nor petitioner shall be harassed in future.  In fact petitioner intends to encroach common street.  Learned A.A.G., states that official respondents shall strictly act in accordance with the law and will not indulge in any illegal activity.  In these circumstances, learned Counsel for the petitioner is satisfied and does not press the petition.  Without prejudice to the rights of the private respondents on the public street, in above circumstances the petition is disposed of accordingly.
