                        During course of the arguments Mr.Ashfaque Hussain Abro, advocate for  the applicant/surety pointed out that accused Serwer Siddique  for whom applicant had stood surety had expired on 29.07.2006  and for that reason accused could not appear  before the trial Court as he was not in this world.  Learned advocate for the applicant submits that an opportunity may be provided to surety for producing the death certificate of late accused before the trial Court and to pass  appropriate  order in the light of death certificate  of the accused. 

                        Learned State Counsel recorded no objection.

                        In the above stated circumstances,  by consent order dated 14.06.2012 is set aside.  Matter is remanded to the learned 2^nd Additional Sessions, Larkana to consider death certificate of accused Serwer Siddique issued by UC No.10 Landhi  Town Karachi in accordance with law thereafter to pass appropriate order after hearing  both the parties.  This exercise  shall be completed by the trial Court within one month.  The application stands disposed of accordingly.
