Through this application under order 23 rule 3 CPC duly signed by / on behalf of the appellant and the respondent and their respective counsel, it is stated that the dispute in the matter has amicably been settled between the parties, in terms of agreement dated 14.09.2012, a photocopy whereof is annexed to the application. It is requested that the appeal be disposed of with a direction that the amount of Rs.23,310,482/= deposited by the appellant with the Nazir of this Court be paid to Rana Qamar uz Zaman, the guarantor and attorney of Fazal Wadood, the respondent; whereas the profit earned on the aforesaid amount upto 26.5.2012 being Rs.18,232,518/= be paid to ABL, the appellant with further profit that may be earned till the date of payment. Both the learned counsel submit that the application has been signed by / on behalf of their respective client in their presence and that the counsel are duly authorized for and on behalf of the parties and that the application be granted and the appeal be disposed of in terms of the agreement dated 14-09-2012 as well in terms as contained in the application and noted above.

The application is granted. The appeal stands disposed of in the fore-goring terms.
