Through this application under order 23 rule 3 CPC duly signed by / on behalf of the respondents and their counsel, it is stated that the matter in dispute has been settled through agreement dated 14-09-2012, in pursuance whereof Suit No. 570 of 1997 filed by respondent No. 1 against the appellant and the respondent No. 2 has been satisfied. Mr. Mazhar Imtiaz Lari, advocate submits that the present appeal has become infructuous and be disposed of accordingly.  Mr. Khadim Hussaiin Metlo, advocate holding brief for Mr. M. Salim Thepdawala, advocate for the appellant verifies the above and has no objection to the present appeal being disposed of as infructuous.

                        The appeal, in the circumstances, is disposed of in the foregoing terms.
