                        Present petition has been filed  with following prayer:

a. That this honourable court may graciously be pleased to direct the respondent No.1 to produce the record that to whom the tenders has been issued and how much contractors participated in bid.

b. To direct the respondent No.1 not  to issue work order without completing codal formalities.

c. To direct the respondent No.4 to conduct an inquiry regarding ill behaviour of Respondent No.1 and 2 and submit such report before this Honourable Court.

            The Administrator, Taluka Muncipal Administration, Garhi Khairo filed statement in this Court alongwith an order dt.31.10.2011 wherein  at Para No.3 & 4 it is stated as under:

1. AND WHEREAS, the Taluka Officer (Infrastructure), TMA, Garhi Khairo  has reported that neither work orders of the said N.I.T have been issued  nor any record of the said N.I.T is available in the office.

2. AND WHEREAS, my predecessor, Ex-Administrator, TMA, Garhi Khairo, Mr. Nasrullah Sarki drawn a loan of Rs.38,00,000/= (Rupees Thirty Eight Lacs) out of Rs.2 Crore of MPA funds and utilized the said amount on payment of contingency bills, miscellaneous bills and liabilities to the contractors in his personal  interest  without any justification hving no legal authority.  As such, shortfall of Rs.38,00,000/= has been made by him in the funds of MPA Priority Programme illegally.

                        In view of the statement and order referred to as above, present petition  has become infructuous and same is dismissed.   In case present petition has any fresh cause of action, he may file fresh petition if so advised.
