Admittedly the appellants have so far been able to pay the total amount of Rs.54.20 million towards the satisfaction of the decree for Rs.110.00 million. It is, therefore, agreed between the parties that the appellants shall within a period of three months from today endeavor to obtain buyers for the property mortgaged by them in favour of the respondent bank, who shall make payment within such time. However, in case, the payment as mentioned above is not made, the Official Assignee shall proceed to re-start the sale proceedings in accordance with law. For doing so he shall take effective control of the factory premises, as it has been complained by the appellants that certain parties who were interested in purchasing the property could not do so as they were prevented from entering the factory premises for the purpose of inspection and evaluation. We would, therefore, direct the learned Official Assignee to facilitate such genuine buyers in the above exercise. In doing so, the appellants shall extend their fullest cooperation to the learned Official Assignee, however, still any difficulty crops up, the Official Assignee may seek police assistance.

The appeal, along with the pending applications, stands disposed of, in the foregoing terms.
