                        Through this criminal miscellaneous application, learned advocate for the applicant/accused has stated that Court of learned Sessions Judge/Special Judge for CNS Shikarpur is lying vacant.   Mr. Kalwar  has been posted as Sessions Judge, Shikarpur but due to road accident he has not taken charge.  Incharge Sessions Judge has refused to entertain the bail application in the Narcotics cases on the ground that he has not been notified as Special Judge for C.N.S Shikarpur.  It is stated that applicant/accused is in jail without hearing of his bail application.  

            Learned advocate for the applicant submitted that his case alongwith bail applications may be transferred to the learned Sessions Judge/Special Judge for C.N.S Larkana for expeditious disposal of the case.

            Learned State Counsel recorded no objection. 

                        Therefore, by consent, in order to avoid  delay in the disposal of the  bail application  which is urgent matter and under the National Judicial Policy  2009 bail applications are to be decided  within specific  period.    By exercising inherent  powers of this Court and to secure  ends of justice, treating this application as transfer application, case bearing  crime NO.39/2012  registered at P.S Lakhi against/accused  U/S 9(B) Control of Narcotics  Substances Act 1997 alongwith bail application is transferred to the learned Sessions Judge/Special Judge for C.N.S Larkana  with direction to decide the same expeditiously.                    

            The applications stand  disposed  of accordingly.
