By order dated 20.02.2012, upon an undertaking by the petitioner for furnishing a tangible security for the decretal amount to the satisfaction of the Nazir of this Court within 15 days from the aforesaid said, notice was ordered with a caution that in case petitioner fails to make such deposit, the present petition shall stand dismissed. The decretal amount till date as submitted by Mr. K.A. Wahab, advocate comes to Rs.4,40,000/= and on 08.9.2011 i.e. much before passing of the above order was Rs.4,15,000/=. The above is not refuted by the counsel for the petitioner.

In the circumstances, and since the petitioner has failed to comply with order dated 20.02.2012 fully, we have no other option but to dismiss the petition as so envisaged in order dated 20.02.2012. The petition alongwith the pending application stands dismissed as withdrawn. The petitioner may withdraw the amount deposited by him with the Nazir of this Court.
