2)         Learned counsel submits that the parties have reached at an out of Court settlement and as such the plaintiffs do not wish to pursue this suit and if they are aggrieved by violation of any terms of the settlement which the parties have reached outside the Court, they may file a fresh suit. Be that as it may, since the plaintiff has moved application for unconditional withdrawal of the suit, I see no impediment in granting this application, which is accordingly granted and the suit is dismissed as withdrawn along with pending applications. Plaintiff is, however, at liberty to file fresh suit in case a fresh cause of action arises for which he does not need any permission.
