2)         By this application the plaintiff seeks permission to withdraw the suit. Earlier also, as is reflected in order dated 28.12.2011, the application for withdrawal of suit (CMA 12249/2011) was filed through the attorney, however, since the attorney was not authorized to withdraw the suit in terms of the power/authority, annexed with the application, the application was not granted and the matter was adjourned. The plaintiff now has filed fresh application for withdrawal of the suit annexing therewith fresh power of attorney duly notarized by the Notary Public, State of Texas and attested by Consulate of Pakistan Houston whereby the executant has authorized the attorney to withdraw the suit. Consequently, the present application is allowed and the suit is dismissed as withdrawn, along with all pending applications, with no orders as to costs.
