              Learned counsel for the petitioners submits that since the auction proceedings have already been taken place, the present petition has become infructuous; however, his grievance now is that he was unlawfully prevented from participating in the auction /sale and the petitioners shall be satisfied if their application for participation in the auction/sale be decided strictly on merits. 

              We would, therefore, dispose off this petition by directing the Trial Court seized of the matter,  to decide the petitioner’s application for participation in the Auction proceedings afresh, strictly on merits, in accordance with law and through a speaking order.
