          In the comments submitted by respondents No. 2 and 3, the merit number of the petitioners are stated and thereafter it is stated that in their union council there was no vacancy. The policy of the Government has been that in case of Primary School Teacher the recruitment shall be on the basis of union council. This aspect of the policy has been upheld by a division bench of this Court in Constt. Petition No. D- 850 of 2010, decided on 08.07.2011. Since there is no vacancy in the union council to which the petitioners belong, this constitutional petition is dismissed.
