Mr. Ashfaque Hussain Abro, Advocate filed Vakalatnama on behalf of respondents No. 4 to 7, alongwith their comments; in which they have clearly stated that neither they have leveled any kind of false allegation of “Karo-Kari”, nor demanding any amount from the petitioner. They further contended that they have also not assaulted upon the petitioner party, however a copy of F.I.R No. 03/2012, lodged with P.S Mirpur Buriro, under section 376, 452, 34 P.P.C. has been produced alongwith medical certificate, which is lodged against Mehboob Ali and others.
The learned counsel for the petitioner argued that this harassment petition was filed on 6th December, 2011, and false F.I.R has been lodged against son of the petitioner Mehboob Ali and her other relatives on 25.01.2012, and that F.I.R has been registered on the orders of Justice of Peace.
So for as harassment is concerned, all the respondents are directed not to cause any harassment to the petitioner and they shall act strictly in accordance with law. So for as the question of false F.I.R is concerned, the learned counsel for petitioner argued that bail before arrest has been obtained by the accused persons and he will initiate necessary proceedings for quashment of the F.I.R separately. Learned counsel further submits that SHO may be directed to assign investigation of the case to some honest officer. The Investigating Officer shall ensure that entire investigation is conducted honestly, impartially and in accordance with law.
The petition stands disposed of.
