                        The applicant has challenged the order dated 22.11.2010 passed by the learned Special Judge, Antiterrorism Court, Jacobabad in Crime No. 129 of 2010 whereby he observed that section 395, 396, 397 PPC are not scheduled offence under ATA and offence has no nexus with section (7) ATA therefore, he returned papers to I.O with direction to submit the same before competent Court of law.

                        Learned State Counsel supported the impugned order  and further argued that after returned back the police papers learned Sessions Judge Kashmore at Kandhkot has already framed the charge and matter is fixed for evidence.  

                        After arguing  at some length, learned counsel for the applicant submits that he would be satisfied  if directions are issued to the trial Court to  conclude the trial expeditiously. 

                        By consent, this criminal miscellaneous application is disposed of with the direction to the learned trial Court to conclude the trial within three months and pass the judgment and submit  the compliance report to this Court through Additional Registrar of this Court.
