              Mr. Muhammad Nawaz Shaikh, learned counsel for the petitioners files an application under order XXIII rule 1 CPC  for withdrawal of the petition.  It is stated that after retirement of respondent No. 4, the instant petition has become infructuous; however, the petitioners reserve their right to initiate legal proceedings against respondent No. 4.

              The application is granted.   The petition alongwith the pending applications stands dismissed as withdrawn. The petitioners may however, if so advised, file appropriate proceedings against respondent No. 4.
