                        Learned counsel states that she wants to press this  bail application only on the statutory ground of delay because the applicant was arrested on 29.03.2007 and according to learned counsel the applicant is not responsible for delay in disposal of trial and neither is he a dangerous or hardened criminal.

             When confronted with this position, learned State Counsel contended  that application on statutory  ground of delay has not been filed in the trial Court   which should have been filed in the first instance.   Upon this, Miss Rubina Dhamrah states  that the transfer application has been filed in this court and that application is pending and she apprehends  that in view of pendency of transfer application the trial Court may not entertain such bail application. 

                        This bail application is disposed of  by directing the trial Court  to consider  bail application on statutory delay ground if filed  and to decide  the same in accordance  with the law  within a period of one month of  it being filed.

                        Listed applications are also disposed of.
