09.12.2011

Mr. Nazir Ahmed Bangwar, advocate for the applicant along with applicant.

Mr. Qazi Muhammad Bux, State counsel.

                                                -----------

1.         Office objection overruled.

2.         Urgency application is granted.

3.         Exemption application is granted.

4.         Per learned counsel applicant is innocent and has nothing to do with the above offence. However, due to malafide intention he has been implicated in crime No.14/2009 of Police Station, Rasaldar district Kashmore at Kandhkot. It is further contended that neither the applicant was aware the above case nor he has any nexus with the same but he just came to know when non bailable warrants were issued by the trial court against the applicant. Per learned counsel, the applicant intends to surrender before the trial court but trial court ;has already issued non bailable warrants against him, therefore,  he is unable to appear before the trial court for protective bail.

Learned State counsel did not oppose the application.

Without touching merits of the case applicant Muhammad Hassan alias Hasnoo son of Qabool Sabzoi is granted protective bail for seven days to enable him to appear before the trial court subject to furnishing solvent surety in the sum of Rs.100,000/- with P.R bond in the like amount to the satisfaction of the trial Court. Meanwhile operation of the non bailable warrants issued against the applicant is suspended till 15.12.2011 or when the applicant appears before the trial Court whichever is earlier.

Criminal Bail Application stands disposed of.
