4.         Learned counsel for the petitioner submits that the petitioner is enrolled advocate and is member of District Bar Association Larkana.  He has received  injuries in a quarrel  with persons named in the petition.   Learned counsel further submits  that  respondent No.1 is avoiding  to lodge  the FIR  of the  petitioner  though the letter was issued  by respondent No.1 for medical treatment of the  petitioner and such certificate was issued by the  Medico Legal Officer.    He submits that  it is fundamental right of the petitioner that his statement may be recorded, if a cognizable offence is made out, such statement may be recorded in 154 Cr.P.C Book.

                        Mr.Naimatullah Bhurgri, waives notice of this petition   and in view of the above circumstances,  states that he has no objection if the respondent No.1 is directed to recorded statement of the petitioner  who is a practicing advocate  of District Bar Association Larkana.

                        For the following reasons, respondent No.1 is directed to record   statement of the petitioner, if any cognizable offence is made out, his statement is to be recorded in 154 Cr.P.C Book. 

                        Petition stands disposed of in the above terms.
