3. The
applicant has applied for protective bail in Crime No. 108 of 2009, P.S. C-Section
Sukkur, lodged under sections 324, 114, 337-H(ii), 504, 34 PPC.
The
complainant lodged the FIR with the allegation that on 23.09.2009 he congratulated
Eid to their maternal uncle and they were taking tea at the hotel, where the
applicant alongwith co-accused came there and on the instigation of co-accused
Abdul Ghafoor and other took out T.T.Pistols from their folds and accused Abdul
Haleem fired upon complainant party which hit Muhammad Sulleman, thereafter the
accused persons went away by abusing and making aerial firing.
Learned
counsel argued that even in the FIR there is no specific rule attributed to the
present applicant except that he was allegedly present at the place of
occurrence/incident. Learned counsel further submits that since the trial court
is surrounded by the police officials, therefore, the applicant is not in a
position to surrender himself before the trial Court and obtain bail.
Without
touching the merits of the case, the applicant is granted protective bail for a
period of seven days subject to executing P.R.bond in the sum of Rs.100,000/- (Rupees
one lac) to the satisfaction of Additional Registrar of this Court. The
applicant shall surrender before the trial Court within seven days from today
and move bail application. This protective bail order will automatically be withdrawn
after expiry of seven days from today or when the applicant approaches the
trial Court, whichever is earlier.
Bail
application stands disposed of accordingly.
