The main grievance of the petitioner is that the injures are clearly visible in the medicolegal certificate issued on 26.7.2011 but the respondent No.3 has simply registered N.C. and not registering the FIR and even in the N.C. the names of actual culprits have not been mentioned. The specific allegations have been leveled against the respondents No.4 and 5. The respondent No.4 is present in person and he submits that respondent No.5 is his brother and he is not present today and he does not want to engage any counsel for his defence, however, he denies allegation that he is ever beaten or threatened the nephews of the petitioner. The respondents No.2 and 3 have also filed their comments. SIP Bashir Hussain Bhayo in his comments submitted that on 22.7.2011 the petitioner and the relatives of respondents No.4 and 5 fought with each other on some family matter, for which both the parties recorded N.C. and he further assure that no incident was taken place on 23.7.2011.

The learned A.A.G. submits that directions may be issued to respondent No.03 to record the statement of the petitioner and if any cognizable case is made out, the concerned S.H.O. will act in accordance with law.

The petition is disposed of with the direction to respondent No.3 to record the statement of petitioner verbatim and if any cognizable case is made out from the statement, the further action will be taken strictly in accordance with law.
