3- This is a protective bail moved by the applicants in Crime No.162 of 2010, P.S, Ubauro District Ghotki. Earlier to this bail application the same applicants had moved bail application No.705/2011 and vide order dated 02.08.2011 this Court granted them protective bail for seven days enabling them to file bail application in the competent court. The learned counsel urged that the protective bail was granted on 02.08.2011 and immediately on 03.08.2011 bail before arrest application was moved in the Court of Sessions Judge Ghotki, which is pending for orders on 12.08.2011, therefore, the fresh application for protective bail has been moved on the ground that inspite of reasonable time, the bail application could not be decided by the trial court and there is imminent apprehension that the applicants will be arrested because the seven days time granted in the protective bail has already been expired.

The learned A.P.G. has waived the notice, he has no objection if protective bail is granted keeping in view the aforesaid circumstances.

The application is allowed. All the applicants are granted protective bail for three days only subject to furnishing solvent surety in the sum of Rs.100,000/- each with P.R. bond in the like amount to the satisfaction of the Additional Registrar of this Court. It is clarified that if the trial court dismises the bail application on 12.08.2011, this protective bail will cease to have any effect.
