3. Through instant Criminal Revision Application the Applicant has called in question Order dated 11.06.2011 whereby his application for supplying of copies of Note Sheet N/01 to N/134 was dismissed.
Counsel for the Applicant contends that in the investigation report, the investigating officer at page-9 of the Reference has referred to the said paragraphs of the Noting Sheet whereby certain legal opinion was given for moving application for setting aside compromise decree and such opinion was disagreed by the DPGA but ultimately DG agreed to the earlier opinion of filing application under Section 12 (2) CPC.
On our query, learned counsel was not in a position either to disclose any prejudice which may be caused to the Applicant on account of non-supply of such Note Sheet nor was in a position to state that such Noting Sheet was ever relied by the Investigating Officer whose statement has already been recorded. Counsel was further not in a position to state the value of such opinion or its effect on decision of the main case against the Applicant. Perusal of the order impugned further verifies this position that the Investigating Officer in his Examination-in-Chief has even not relied upon such Noting Sheet. On the contrary the Applicant himself has produced the copy of plaint. No case for interference with well reasoned order is made out. The Revision Application consequently, is dismissed in limine.
