Mr. Syed Mamnoon Hassan Advocate for respondent No.1.--------------On the previous date both the learned counsel were directed to argue the matter today and we had asked Mr. Mamnoon Hassan learned counsel for the respondent No.1 that he should satisfy us that the Banking Court has proper jurisdiction to pass order against the present appellant. Mr. Mamnoon Hassan submitted that this point was not raised before the Banking Court therefore it cannot be raised before this court at this stage. Although we have observed that there is settled law that this point can be raised at any stage. Mr. Mamnoon Hassan relied upon number of judgments to support his contentions. Without discussing the merits or demerits or applicability of the jurisdiction of the Banking Court, we asked Mr. Mazher-ul-Haque, learned counsel for the appellant to show us even one case that this point can be raised at any stage but the learned counsel wanted to argue the matter on merits but kept stating that the Banking Court had no jurisdiction and relied upon a judgment but he has not been able to produce even one judgment in support of his contention that this point can be raised at any stage. This Court cannot hold brief on behalf of appellant’s counsel and therefore we are adjourning this matter, to be fixed after summer vacation according to roster, but since the ad interim order had been passed and the learned counsel for the parties were put to notice that this matter shall be finally heard and decided at katcha peshi stage but today it could not be disposed of due to non-preparation of learned counsel for the appellant, therefore, the ad interim order passed on 21.12.2010 is hereby vacated.
