2.         Through this application applicants seek protective bail in crime No.6/2011 under Section 148, 149, 324, 353 7 ATA 13-D of Arms Ordinance of Police Station Shaheed Benazirabad.

Learned Counsel for the Applicants contends that the Applicants have been falsely implicated in the instant crime and since the NBWs have been issued, therefore, it is not possible for the applicants to approach the Court of first instance and seeks relief in accordance with law. Per counsel if  the NBWs are suspended for reasonable time the applicants would move the Court of first instance in order to seek remedy of bail in accordance with law.

Without touching the merits of the case, and only to enable the Applicants to approach the Court of first instance, the applicants upon suspension of Non Bailable Warrants are granted protective bail for a period of 07 days to expire on 03.07.2011 after Court hours, upon furnishing solvent surety in the sum of Rs.100,000/- each (One Hundred Thousand) and P.R. bond in the like amount to the satisfaction of Nazir of this court. It is made clear that in case, the applicants fail to surrender before the trial Court within the time specified then the surety furnished before this Court shall stands forfeited.

Bail Application disposed of in above terms.
