22.06.2011

Mr. Shamshad Ali Qureshi Advocate for the Applicant

…………..

1.         Granted.

2.         Since the counsel is seeking protective bail, not pressing the main application, therefore, the office objection is overruled.

3.         Granted subject to all just exceptions.

4.         The applicants initially have prayed for interim pre arrest bail in crime No.6/2011 under Sections 419, 420, 468, 471, 109, 34 PPC of police station FIA SBC, Karachi but since there was no reason for not approaching the Court of first instance, therefore, we were not inclined to exercise concurrent jurisdiction, consequently, at the request of Counsel this bail application for interim relief is treated as application seeking protective bail.

Counsel contends that since the Court of first instance is surrounded by the officials of FIA, therefore, it is not possible for the applicants to approach the Court of first instance and only in order to enable the applicants to approach the Court of first instance they may be admitted to protective bail.

Without touching the merits of the case, the applicants are granted protective bail for a period of 07 days to expire on 29.06.2011 after Court hours, upon furnishing solvent surety in the sum of Rs.100,000/- each (One Hundred Thousand) and P.R. bond in the like amount to the satisfaction of Nazir of this court. It is made clear that in case, the applicants fail to surrender before the Court of first instance within the time prescribed then the surety furnished before this Court shall stands forfeited.

The application stands disposed of in above terms
