            Initially Crime No.200/2009 was triable by the Anti Terrorism Court crime and the bail application of Syed Zeeshan Ali Haider was rejected by the Anti Terrorism Court vide Order dated 14.10.2009. Thereafter, per State Counsel the case was transferred for trial to the Court of ordinary criminal jurisdiction and therefore, the instant bail application is not maintainable as the order by which the bail application of the applicant was rejected, has lost its value and utility. In view of this position this bail application has become infructuous.

Conversely, Counsel for the Applicant says that if it is so, then he would move bail application before the Court of first instance i.e. District & Sessions Judge of the relevant district and the Court of first instance be directed to decide the bail application at the earliest.

We therefore, while disposing of the instant bail application direct that as and when the bail application of the applicant is moved before the Court of first instance, the same shall be decided within a period of 7 days without being influenced of order passed by the Anti Terrorism Court.

            Bail Application stands disposed of.
