In this petition the order dated 13.5.2008 passed by the V-Additional Sessions Judge, Larkana is impugned. According to learned counsel for the petitioner, bail application was moved on merit and hardship grounds before the trial Court which was dismissed and then he preferred the Crl.Bail Application No.191/2007 before this Court which was also disposed of by giving four months time to the trial Court to conclude the trial but the trial Court did not conclude the same, therefore, he again repeated the bail application which was dismissed as such he has preferred the present criminal bail application.
The perusal of impugned order shows that charge was framed against accused after completing formalities against absconding accused persons on 22.5.2007 by II-Additional Sessions Judge, Larkana who was later on transferred in the month of November, 2007. As such process against the P.Ws were not issued then the V-Additional Sessions Judge received the case on 12.5.2008 which was already fixed on 19.5.2008. The learned Judge has mentioned in his order that now he will take coercive steps for disposal of the case as soon as possible by procuring the attendance of the P.Ws. At present this Court is informed that again the Court of V-Additional Sessions Judge, Larkana is lying vacant due to transfer of its Presiding Officer, as such by consent of the leaned counsel for the petitioner and the State counsel, Sessions Case NO.233/2004 is transferred to the Court of 1st Additional Sessions Judge, Larkana with the direction to conclude the case within a four months time. Office is directed to send the copy of this order immediately to the Court of V-Additional Sessions Judge, Larkana with direction to send R&Ps to the Court of 1st Additional Sessions Judge, Larkana for compliance of the above directions.
In view of the above, petition stands disposed of.
