J U D G M E N T

 

 

SAJJAD ALI SHAH, J. -      The Appellant has called in question judgment dated 30-04-2005 passed by Special Judge, Narcotics, Mirpurkhas in Special Case No.08/2003, crime No.05/2003 of PS Excise, Umerkot, under section 9 of C.N.S. Act, 1997, whereby the learned Judge after regular trial of the Appellant found him guilty of offence under section 9 (b) of C.N.S. Act, 1997 and convicted him to suffer R.I for a period of four years and also imposed fine of Rs.20,000/- and in case of default, he was to undergo another period of three months.

            The record reflects that the Appellant after completion of sentence has been released from Jail on 21-10-2006. Consequently direct notices to the Appellant for today’s date of hearing were issued but neither the Appellant is present nor any one has effected appearance on his behalf. The payment of fine by the Appellant reflects the admission of guilt and therefore, in our opinion, the impugned judgment which even otherwise appears to have been rendered after considering and scrutinizing all material on record. We have also gone through the entire record and find no reason to interfere with the impugned judgment and consequently dismiss the Appeal.
