                                                            J U D G M E N T.

 

SAJJAD ALI SHAH,J:- The appellant upon being found in possession of 110 grams of Charas was convicted and sentenced to suffer rigorous imprisonment for 15 months and to pay fine of Rs.5000/- by the Special Judge, CNS, Dadu, in Special Case No.349 of 2004, under section 9(b) of Control of Narcotic Substances Act, 1997.

            On 02.02.2006, this Court suspended the sentence of the Appellant subject to furnishing surety in the sum of Rs.50,000/-, however, the record reflects that the Appellant did not avail the benefit of such order and now the Superintendent Central Prison, Hyderabad has informed that the Appellant upon completion of his sentence on 02.09.2006 has been released.

            We have thoroughly examined the judgment as well as the record and do not find any reason to interfere with the well reasoned judgment, whereby the Appellant was convicted under section 9(b) of Control of Narcotic Substances Act, 1997. We consequently hereby dismiss the appeal.
