None for the petitioner nor any intimation received.  On 22.02.2011  when the matter was taken up  for hearing no one   was in attendance on behalf of the petitioner.  Learned  counsel for the respondents No.1 to 3  informed the court   about the pendency  of matrimonial  dispute between  the petitioner and respondents.  It was further  intimated that  the suit for khulla / dissolution of marriage   was filed  by the petitioner  against the respondent  No.1  which has been decreed whereas  suit filed by Mst.Shahida, sister of respondent NO.1 against the petitioner No.3 is pending before the competent court of jurisdiction.   Learned counsel for the respondent stated that the instant petition  was filed  merely to cause harassment to the respondents.

It has also been informed that the counsel representing the petitioners  namely Mr.Siraj Ali Chandio  has  migrated to  Karachi on account of some family problems and not in a position to attend this court.  In view of  such  position,  the notices were directed to be issued to the petitioner.  It appears that the notices were issued however, no one is in attendance.  The private respondents present in Court  undertakes  that they will not cause any harassment  to the petitioner in whatsoever manner and shall continue to proceed  in accordance with the law in respect of redressal of their grievance if any.

Learned Asstt: A.G sates that in view of the undertaking  given by the  respondents,  the instant petition has become  infructuous.

However, since no one is in attendance on behalf of the petitioners,  the instant petition is dismissed for  non-prosecution.
